Martina Maier is a German qualified Rechtsanwältin and partner in the international law firm of McDermott Will & Emery, based in the Brussels office.  Martina is head of the firm’s European Antitrust and Competition Practice Group. 

Her practice focuses on German and European competition law, including all competition aspects of M&A transactions (from the structuring of the deal to merger control proceedings), single firm conduct, agreements restricting competition and State aid.  She has extensive experience in representing clients before the European Commission, national competition authorities and European courts.


Martina is recommended by numerous publications and legal directories such as, Chambers Global, Chambers Europe, the JUVE Handbook of German Commercial Law Firms, the International Who's Who of Business Lawyers and European Legal Experts.  She is also featured in Global Competition Review's Leading Women in Antitrust and Euromoney’s Guide to the World’s Leading Women in Business Law. 


Martina has written and spoken widely on competition law matters.  Recent publications include New EU Guidelines on Regional Aid for 2014-2020, Practical Finance Strategies (July 2013), the chapter on the “European Union” in the book, Leniency Regimes, 4th edition 2012 (Nov 2012); “Passing-on defense in German follow-on antitrust damage claims” Der Betrieb (Jan. 2012); “Les services d’intérêt économique général et le marché intérieur – Le régime allemand”, Société de Législation Comparée (Jan. 2012); “Restructuring of Companies” Merger Control – Beck Verlag (July 2011) and “Compliance Training” 9 Ed. – Competition Compliance – EUROFORUM Verlag (March 2011).  She is co-author of the “Best Business Economics Article” – 2012 Antitrust Writing Awards.

Martina is Non-Governmental Advisor to the International Competition Network (ICN) for the EU and Vice-President of the Competition Law Committee of the Union Internationale des Avocats (UIA).  Further memberships include European Competition Lawyers Forum (ECLF), the International Bar Association (IBA), American Bar Association (ABA), Association of French Competition Lawyers (AFEC), Women's Competition Network and the Alumni Association of the Ecole Nationale d’Administration.

 

Representative Experience


- Representation of an interested party that actively intervened in EU merger control proceeding Access/PLG (M.6884).

- Representation of the German State Rhineland-Palatinate with regard to an on-going second phase State aid investigation by the European Commission concerning alleged aid of €485 million for Nürburgring GmbH, a racing track and leisure park.

- Advice to and representation of a French subsidiary of a German group in European and French competition law, including in proceedings before the French competition authority concerning alleged infringements of Articles 101 and 102 TFEU and the respective provisions of French competition law including intervention at the Paris Court of Appeals

- Advice to and representation of Ford Motor Company in several complex State aid matters

- Successful representation of European postal operators in complaints to the European Commission regarding changes in their national postal law that excluded alternative operators from the market of hybrid mail

- Assistance to a major European energy producer with respect to the compatibility of gas legislation with European law, in particular antitrust, State aid and energy regulation

- Representation of an alliance of seven major European rail operators in the area of cross-border high-speed rail transport.  Strategic advice in relation to EU and national competition law and transport policy issues.

- Regular advice to and representation of companies from different sectors in European, German and multijurisdictional merger control proceedings.

- Representation of telecommunication provider in complex investigation of the European Commission about the alleged abuse of a dominant position
