Samiksha is a qualified lawyer. She graduated from the National Law School of India University, Bangalore in 2010 and completed her Master of Laws / Master of Advanced Studies in International Organisations from the University of Zurich in 2011.
Samiksha is a dispute resolution practitioner with over 11 years of experience. She practices in multiple fora including the Supreme Court of India, the Delhi High Court, the National Company Law Appellate Tribunal and the National Consumer Disputes Redressal Commission. She has extensive experience in constitutional and civil litigation, arbitration and dispute resolution advisory mandates with a focus on constitutional law, commercial laws, shareholder disputes, intellectual property laws, insolvency, regulatory disputes and taxation laws.
She began her career as a litigation associate at S&R Associates, where she worked for five years before starting her independent litigation practice. During her masters, Samiksha was a Research Assistant for Dr. Professor Helen Keller. She assisted Dr. Keller with editorial work for her book ‘UN Human Rights Treaty Bodies: Law and Legitimacy’ and her work at the United Nations Human Rights Committee in 2010. While at the chambers of Mr. Shyam Divan, she worked extensively on the Supreme Court matters relating to India’s biometric project and the reports of use of Pegasus on Indian citizens.
Samiksha has served on the panel GAIL (India) Limited, the Directorate of Revenue Intelligence, the Government of Uttar Pradesh, and has advised the Department of Economic Affairs, Ministry of Finance on securities laws and various issues under the Companies Act. She was also a consultant for the Regulatory Governance Project at the National Law School of India University, Bangalore.
On the private side, she has advised Cairn Energy Plc in public interest proceedings in the Supreme Court of India, Vodafone India in proceedings relating to schemes of arrangement and restructuring of tower assets, IL&FS Transportation Networks in writ proceedings for government tenders and shareholder disputes, Bharat Hotels and CX Partners in shareholders’ disputes and Glencore in disputes relating to contracts of affreightment and in arbitration proceedings before the Indian Council for Arbitration.
Her arbitration experience includes domestic and international commercial arbitrations for a diverse set of clients including a Norwegian oil and gas company in an ad hoc arbitration against an Indian PSU, Alcatel-Lucent in domestic arbitration proceedings against MTNL, Avenue Capitals in a shareholders’ dispute and a Mauritian company in proceedings for enforcement of an LCIA arbitral award.
Samiksha has the unique experience of representing a multinational pharmaceutical group of companies in intellectual property proceedings relating to biosimilar drugs in the Delhi High Court. She has also represented employees in proceedings before the Delhi High Court relating to claims of copyright infringement of software.
Her experience with securities and regulatory litigation includes representing merchant banks before the Securities and Exchange Board of India in proceedings relating to the initial public offering of a real estate company in India and representing a leading engineering and construction company before the Securities and Exchange Board of India and the Securities Appellate Tribunal.
